Terms of Service
These Terms apply to services provided by David R. Bartels, Inc., a Florida corporation at 701 NW 101st Terrace, Plantation, FL 33324, and to use of bartelstax.us. Each engagement is also governed by a written engagement letter; if the two conflict, the engagement letter controls.
1. Services
We prepare federal and state tax returns for individuals and businesses; provide bookkeeping, payroll, and Florida sales tax filing; offer tax planning; and help clients respond to IRS and Florida Department of Revenue notices. You pay for the specific services listed in your engagement letter at the flat fee stated there.
2. Who we are and are not
We are an independent tax preparation and accounting practice. We are not a CPA firm and do not perform audits, reviews, compilations, or other attest services. We do not provide legal or investment advice. Representation before the IRS in examinations, collections, and appeals is provided only through an independent Enrolled Agent you engage separately.
3. Your responsibilities
- You are responsible for the completeness and accuracy of the information you give us and for keeping records that support your returns.
- You must review each return before signing the e-file authorization (Form 8879). Signing confirms the return is true and complete to the best of your knowledge.
- You remain responsible for paying any tax due, including estimated taxes, on time.
- For bookkeeping and payroll, you must provide statements, payroll changes, and funding by the deadlines in your engagement letter.
4. Fees and payment
- Fees are flat and quoted in writing before work begins. If the scope changes (for example, new schedules or additional states), we will tell you and agree on any additional fee before proceeding.
- Tax return fees are due when the return is delivered for signature. Monthly services are billed at the start of each month.
- We do not charge fees based on the size of your refund, and we do not offer refund-anticipation loans.
- We may hold e-filing of a return until the fee is paid, but you are always entitled to your original documents.
5. Deadlines and extensions
Documents received after March 25 for individual returns (or February 25 for partnership and S-corporation returns) may require an extension. We'll file extensions when needed at no extra charge for clients with signed engagement letters. An extension extends the time to file, not the time to pay.
6. Accuracy guarantee
If a return we prepared is incorrect because of our error, we will correct it at no charge and reimburse penalties and interest charged by the taxing authority as a result of our error. We do not reimburse the underlying tax, which you would have owed regardless. Details are in our Refund Policy.
7. Confidentiality and records
We handle your information as described in our Privacy Policy. Your original documents remain yours and will be returned on request. Our workpapers remain our property but we'll provide copies of your filed returns at any time.
8. Ending an engagement
Either party may end an engagement with written notice. You'll be billed only for work completed to that date. We may decline or end an engagement if information provided appears false, or if a client asks us to take a position we believe is not supported by law.
9. Limitation of liability
Except for our accuracy guarantee, our liability for any claim related to our services is limited to the fees paid for the engagement giving rise to the claim. We are not liable for consequential damages or for errors caused by incomplete or inaccurate information you provide.
10. Complaints and disputes
Please contact support@bartelstax.us or (954) 475-2836 first. We acknowledge complaints within 1 business day and respond in writing within 5 business days. Unresolved disputes will be submitted to mediation in Broward County, Florida before any lawsuit. These Terms are governed by Florida law, and venue is Broward County, Florida. You may also report preparer misconduct to the IRS using Form 14157.
